ABOUT THIS POSITION

Location: Hybrid (2-3 days onsite) in Arlington, VA

The Americas Regional Paralegal will be responsible for assisting in providing day-to-day contract administration claims management and legal support for Fluence projects located throughout the Americas region.
 
The Americas Regional Paralegal is a valued and trusted partner of both the customer, legal, and the construction project execution teams, in addition to the various internal departments. The role is important given its potential to directly impact and contribute to the company’s goals to increase business performance, mitigate project risks, and overall to enhance the reputation of our business amongst Fluence’s customers.
 
This role serves as a major conduit between the legal team, external counsel (where applicable) and senior management in support of key company initiatives and objectives. Under the day-to-day supervision of the Americas Regional Head of Contracts & Claims Management and the Americas Legal Team, the Americas Regional Paralegal will work closely with Project Managers, Portfolio Finance Managers (PFM), Paralegal, Legal, Finance, Scheduling and Technical Accounting internal departments reporting to the Americas Regional Head of Contracts and Claims Management. 

As Americas Regional Paralegal, you must be:

·       Possess strong time management skills
·       Attentive to details, efficient yet tenacious to obtain the facts coupled with a sense of urgency required to meet critical deadlines
·       Diplomatic and courteous by using appropriate and effective tone in all verbal and written communications.

We are looking for a self-starter who takes the initiative and has the ability to work independently as well as an integral respected member of project and inter departmental teams. Candidates must possess strong forensic capabilities and be experienced in carefully drafting project correspondence, reports and claims utilizing accepted methods to quantify both delays and damages for large multidisciplinary energy-focused EPC construction projects.

Responsibilities
 
Forge strong respectful rapport quickly and efficiently with project teams and internal departments in order to identify and pursue/ mitigate/ maximize commercial and contractual risks, claims and additional revenue optimization opportunities with our customers, vendors, subcontractors and/ or our internal stakeholders.
Develop, evaluate and process claims and/ or counterclaims, back charges and such like against counterparties in accordance with company policies and procedures.
Develop and/ or refine contractual change orders and/ or contract amendments.
Research and communicate with internal stakeholders and external attorneys and third-party engineers and consultants to investigate project and corporate related contractual claims and legal related matters.

Organizing documentation related to the Fluence Americas Regional Projects Portfolio
Input and entry of data pertaining to Lien tracking/ filing services.
Researching technical references, and legal matters
Ensures that claims are properly endorsed, entered into organizational databases, and securely maintained.
Engage internal and where required external stakeholders in negotiation-related decisions involving legal, finance, project management and/ or regulatory requirements, contract standards, adherence to company policies, contractual changes, and/ or cost targets.
Review and analyze claim information and contractual obligations for in-process claims (EPC and/ or Service warranty claims) in order to determine proper resolution and to identify and resolve errors prior to implementation of final resolution.
Evaluate projects and engage with project management personnel and/ or Regional Management to determine and measure delay impacts using recognized cost, contracts and claims/ dispute resolution methodologies and strategies.

Required travel: approximately 25 - 30%. Primarily domestic travel.

What does the ideal candidate bring to Fluence?

    • Bachelor’s Degree or comparable paralegal experience; Paralegal Certificate highly preferred.
    • 5-10 years of experience as a corporate paralegal at a multinational company or law firm.
    • Possess strong competencies in legal technical writing and data research/ analysis.
    • Proficient in Microsoft Office 365 applications, notably Outlook, Excel, Word, Teams, PowerPoint and SharePoint.
    • Prior Netsuite, Salesforce and/ or Primavera experience would be an advantage. 
    • An understanding of global battery storage solutions and construction methodologies is a plus
    • Strong interpersonal communication skills to coordinate with diverse internal and external teams worldwide.
    • High individual initiative, working with minimal supervision while being a collaborative team player.
    • Possess an entrepreneurial drive for getting things done and have a “whatever it takes” attitude.
    • Has excellent English verbal and writing skills. Additional languages or international work experience are very much considered a plus, such as Spanish or French
    • A desire to make the world a better place through technology.
